ONLINE PURCHASE AGREEMENT
GENERAL
This website ezylife.com.au (Our website) is a shopping site provided by ALC Independent Living Homes Pty Ltd t/as ALC EZYLife (ABN 94 664 590 694) (We, Us, Our, ALC EZYLife Products).
On this website you can browse, select and purchase products sold by Us. Your access to and use of Our website, including your orders and purchases of products through Our website, is governed by these terms and conditions and our Privacy Policy.

PLACING AN ORDER
When you place an order via Our website, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
You may not purchase any products through Our website for the purpose of resale.
Any order you place with us may be rejected by us at our discretion. We may limit or cease sales to an inpidual, household, or specific order at our sole discretion. Such restrictions may extend to orders utilizing the same credit card, sharing identical billing/shipping addresses, or being associated with the same customer account. Orders that appear to have been placed by dealers, resellers, or distributors, may, in our sole discretion, be restricted or cancelled.
PRICING AND AVAILABILITY
- We will charge you, and you agree to pay the purchase price of each product that is ordered, the delivery costs and any other fees and charges set out in these terms and conditions.
- Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the total cost.
- All prices and delivery costs on Our website are in Australian dollars (AU$).
- Whilst we try and ensure that all details, descriptions and prices which appear on Our website are accurate, errors may occur. If we discover an error in the price of any goods which we have advertised, we will correct the error straight away.
- We reserve the right to alter prices and delivery costs for any reason at any time before you place your order.
- We will not be liable or responsible for any failure to perform, or any delay in performance of, obligations under this contract with you where such failure or delay is caused by an event outside Our reasonable control.

When ordering from Our website, you agree to keep your account and transaction details accurate and up to date. This includes promptly updating your email address, credit card numbers, and expiration dates.
PAYMENT
You may pay the fees and charges for an accepted order with any of the following payment methods and such other payment methods as specified on the Site from time to time:

- MasterCard;
- American Express;
- Diners Club;
- Debit cards displaying a Visa or Mastercard logo; and or
- PayPal;
- Afterpay, subject to Afterpay’s terms; and

Upon receiving your order, we may carry out a standard authorisation check on your payment to ensure there are sufficient funds to fulfil the transaction. We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through Our website.
If we are unable to successfully process your nominated payment method for an order that has been accepted by Us, then we may cancel your order.
If you choose to pay by credit card, you authorise us to debit the amount that is payable from your nominated credit card for an accepted Order.
You must not pay, or attempt to pay, for products through any fraudulent or unlawful means.
We will provide you with a receipt at time of delivery which specifies the Total Cost for the products in the order.
DELIVERY OF GOODS

- All standard orders in Australia, unless requested otherwise by you prior to placing your order, all orders will be sent by ordinary Australia Post parcel post without insurance.
- You may receive multiple deliveries for your order.
- While We take all reasonable steps to ensure your order is delivered in a timely manner, we will not be liable for any loss or damage incurred by any person as a result of delay caused by our carrier that we have no control over or by any event which is out of Our reasonable control or foresight including but not limited to any delay caused by an incorrect delivery address being provided to us.
You acknowledge and agree that:
- Any person at the delivery address who receives the products is authorised by you to receive your order; and
- By default, orders include an 'authority to leave' delivery instruction, allowing the postal driver to leave the package where they consider it safe. If alternate delivery instructions are needed, you must provide them before the order is dispatched. If no one is present to accept delivery, you accept the risk of theft or loss of the product from the time it is delivered and acknowledge that, notwithstanding your authorisation, the person delivering the product has discretion whether to leave the product at the address.
- If the person present is unable to prove that he or she is over the required age as prescribed by law or as otherwise set out in these terms and conditions, We reserve Our rights to cancel the order and refund any amounts paid for that order under these terms and conditions (excluding the delivery costs).
FREE SHIPPING TERMS & CONDITIONS
This section outlines the terms and conditions under which ALCEZYLife offers free shipping for online purchases made through our website. These terms are part of our broader Terms and Conditions and by placing an order with us, you agree to these shipping terms.
Eligibility for Free Shipping:
- Free shipping is available for online orders with a subtotal exceeding $250 AUD, calculated before taxes and after any discounts have been applied.
- Free shipping is limited to items weighing less than 5 kilograms and is only available for standard delivery services within the metropolitan areas of Victoria (VIC), Tasmania (TAS), Queensland (QLD), Australian Capital Territory (ACT), and New South Wales (NSW).
Exclusions and Limitations:
- Not all items available on the website are eligible for free shipping. Exclusions apply based on size, weight, or logistical constraints, and ALC EZYLife reserve the right to deny the free shipping at any point of time without further notice.
- Free shipping does not extend to areas outside the specified metropolitan regions, including but not limited to Western Australia (WA) and the Northern Territory (NT). Orders destined for these locations will incur additional shipping charges.
Modification or Termination of Free Shipping Offer:
- ALCEZYLife reserves the right, at its sole discretion, to modify, suspend, or terminate the free shipping offer at any time without prior notice. This includes the right to change the terms, conditions, and eligibility criteria for free shipping.
General Conditions:
- The free shipping offer is subject to change and may be discontinued at ALCEZYLife’s discretion. The company will not be liable to you or to any third party for any modification, suspension, or discontinuance of the offer.
ESTIMATED DELIVERY TIMEFRAMES
All paid orders are processed and dispatched during business hours and days by our warehouse team upon confirmation of payment.
If you need expedited delivery or have specific timing requirements, please contact us immediately after placing your order to facilitate prompt processing at sales@ alcezylife.com.au.
Upon packing and departure from our warehouse, you will receive an email at the address provided during order placement. This email includes the tracking number, allowing you to monitor your order's progress through the Australia Post website.
INTERNATIONAL CUSTOMERS
We currently only deliver to addresses in Australia. If you are located overseas, please contact us prior to placing any order.
RECEIPT OF GOODS
- The person accepting the delivery of your order may be required to provide Us with proof of that person’s identity. If the order has been paid by credit card, then We may also ask you to show Us the credit card for us to conduct verification checks.
- You must inspect the products immediately upon their arrival and if you suspect that a product is damaged on delivery, then you should refuse to take receipt of that product and notify us immediately.
RETURNS AND REFUNDS
Please carefully choose your products. We are not required to give refunds if you change your mind or make the wrong decision.
If you’re not completely satisfied, you can return your purchase via post at the follows address for an exchange, refund or repair in line with our return guidelines and consumer guarantees within 30 days of purchase
We may refuse to accept items returned for change of mind reasons if we reasonably believe that you have engaged in fraudulent conduct or are abusing our policies.
We will accept product returns and provide you with an exchange voucher, refund or repair where:
- The product is faulty or is not of acceptable quality; or
- The product is not fit for its intended purpose; or
- The product does not match the sample or Our description; or
- You have changed your mind, and the products fits our return guidelines; and
- You can provide Us with a receipt or other adequate proof of purchase.
If we determine that you are eligible for a refund for any reason, it will be processed via the original payment method and associated merchant fees will be deducted. Please note that refunds may take several days to appear on your relevant payment method account records.
We may elect to return the product to Our supplier or the manufacturer’s repair agent to determine the nature of a problem.
We reserve the right not to offer an exchange voucher, refund or repair where the item fault is a result of misuse or neglect by you.
Change of mind requirements
If the product is being returned for change of mind reasons, the item being returned must be in a saleable condition, unworn, unused and as sold. For example, the original tags and labels must still be attached, the item in its original packaging (if any), the sealed packaging must remain intact (if any) and if purchased as part of a carton, pack, or bundle, all items within that carton, pack, or bundle must be returned. If you are unsure about the eligibility of your order or product, please contact us at sales at sales@alcezylife.com.au before returning it to Us.
Faulty/defective product
If you suspect a product is faulty or not of acceptable quality, please contact our Customer Service team by submitting an Enquiry Form via our website for investigation and resolution.
To expedite the process, provide the following details:
- Order number
- The affected product(s) name; and
- A photo of the fault (if possible)

CUSTOM MADE AND SPECIAL REQUEST ORDERS
For Custom Made or Special Request products, buyers must provide accurate measurements and requirements before purchase. Detailed specifications are vital. Due to the customized nature of these products, we cannot accept exchanges, returns, or refunds.
RETURN VIA POST
If you order meets our return conditions you can return the item by post. You must enclose your proof of purchase such as the packing slip or copy of your order confirmation email with the return item and address to:

You are responsible for covering all return shipping costs. We recommend you purchase postage insurance and tracking particularly for high value items.
Once we receive and inspect your return, we will notify you about its status and whether it meets the eligibility criteria. If approved, we will confirm the next steps.
RETURN TO SENDER
A return to sender fee will be deducted from the total of your refund for the following reasons:
- Rejected parcel at the time of delivery
- Parcel not collected from local post office / parcel locker (within 10 days)
- Change of address/ incorrect address provide
- Addressee unknown/ ID cannot be verified
- Unable to access the property
- Multiple delivery attempts
If you would like a product to be resent, a shipping fee will be charged, and an invoice will be sent separately. Upon confirmation of payment, we will email you with your new tracking number.
LIMITATION ON CLAIMS
- We have no liability to the extent that Our performance of the contract is prevented by force majeure. For these purposes, “force majeure” means any occurrence or omission as a direct or indirect result of which We are prevented from or delayed in performing any of Our obligations, is beyond Our reasonable control and which could not have been prevented or mitigated by reasonable diligence or precautionary measures, including forces of nature, natural disasters, acts of terrorism, riots, revolution, civil commotion, epidemic, industrial action and action or inaction by a government agency.
- To the extent permitted by law we do not accept liability in respect of shipping delays, transit damages, undelivered packages, or orders arriving at the wrong location due to an incorrect delivery address provided by you or delays caused by international customs.
- We have no liability to the extent that a failure of the product is attributable to any act or omission on your part.
- Our liability for failure to comply with a consumer guarantee is limited to:
- in the case of products supplied by Us, the replacement of the product or the supply of equivalent product (or the payment of the cost of the replacement or supply), or the repair of the product (or the payment of the cost of the repair); and
- in the case of services supplied by Us, the supply of the services again or the payment of the cost to you of having the services supplied again.
- Subject to the prior, no attempt is made to exclude or limit liability arising under the Australian Consumer Law to the extent that there is a statutory restriction on such exclusion or limitation.
- In all other respects, Our total liability for loss or damage of every kind, whether:
- arising pursuant to the terms of service; or
- arising in any other way out of or in relation to the supply of the goods, their sale, delivery or the way they behave, and whether in tort or contract or in any other cause of action, is limited to an amount equivalent to the sum paid by you to Us for the product.
- Except in relation to liability for personal injury (including sickness and death), and except as otherwise stipulated in these terms of service, We do not accept liability to you in respect of any indirect or special loss or damage which may be suffered or incurred by you in respect of products or services supplied pursuant to these terms.
WARRANTY DISCLAIMER
To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded.

TITLE AND RISK
Title in the products does not pass to you until payment has been received. Risk of loss or damage to the goods passes to you upon dispatch.
WAIVER
Any waiver of any provision of the terms of service will be effective only if in writing and signed by us. Without limiting the foregoing, if you breach these conditions and We take no action, we will still be entitled to use Our rights and remedies in any other situation where you breach these conditions.
ENTIRE AGREEMENT
This online purchase agreement constitutes the entire agreement of the parties and supersedes any and all preceding and contemporaneous agreements between you and Us.
GOVERNING LAW
These terms of service are governed by the laws in force in Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
